Emergency Criminal Case Response Guide: How to Quickly Find a Reliable Lawyer and the Responsibilities of Family Members
In criminal cases, it is often the case that the pillar of the family is suddenly arrested, leaving family members who are completely unaware of the situation. In the face of such a chaotic and helpless situation, how can relatives quickly find a reliable lawyer for their loved ones? What actions should family members take to better assist the parties involved and promote the case in a favorable direction?
Taking a recent fraud case successfully handled by our criminal team as an example, I would like to share some experiences with everyone.
One morning, Mrs. Wang's family was having breakfast when suddenly the police knocked on the door and took her husband, Mr. Wang, away. Mrs. Wang was left in a daze, not knowing what to do, and could only wait at the door of the police station. Two days later, she finally received a detention notice stating that Mr. Wang was suspected of fraud.
What is even more concerning is that the local police stated they are merely assisting in the execution and do not know the specific details of the case. The actual investigating unit is in a small city in Yunnan. Mr. Wang is currently being temporarily detained in the local detention center, waiting for the Yunnan police to come for questioning, but the specific time is not yet determined.
At this point, Mrs. Wang realized that only a lawyer could enter the detention center to meet her husband. However, she had spent many years at home taking care of the children, and her social connections were limited, so she didn't know where to start. Finally, she thought of her husband's old friend, Brother Zhao, and through him, she got in touch with us.
During our communication with Mrs. Wang, we guided her to recall the relevant situation. She stated that her husband is honest and would never scam others. The only possible connection is that her husband mentioned selling a portion of USDT last month. Upon further understanding, it turned out that Mr. Wang liquidated some of his held Bitcoin due to significant financial pressure at home.
Based on these clues, we initially suspect that Mr. Wang may have unfortunately received involved funds during the process of selling virtual currency. We quickly formulated a meeting plan, and Lawyer Gao immediately went to the detention center to meet with Mr. Wang.
After communicating with Mr. Wang, we learned more details. He is the owner of a restaurant and, in recent years, due to operational difficulties and family changes, he had to liquidate part of his Bitcoin. He completed a withdrawal transaction worth 500,000 yuan through a legitimate exchange, and the counterparty was a five-star merchant.
We have developed a detailed response strategy for Mr. Wang. A few days later, the Yunnan police arrived for questioning, and as we predicted, the case was related to that virtual currency transaction. Mr. Wang remained calm during the interrogation and clearly stated that he was only engaging in normal transactions and had no unlawful intentions.
Mr. Wang was subsequently transferred to Yunnan. We communicated with the officer in charge and learned that this is a large-scale online fraud case involving multiple locations across the country, with hundreds of people already arrested. The police stated that if he wants to be released on bail, he must return 500,000 "ill-gotten gains."
Faced with this demand, Mr. Wang and his wife find it difficult to accept. This money is the result of normal transactions and has already been used to repay a medical loan, so it is indeed not available at the moment.
We have decided to take a dual approach: on one hand, to submit a detailed legal opinion and exert pressure through various channels; on the other hand, to assist Mrs. Wang in communicating with the police in her capacity as a family member, expressing the family's predicament. We are continuously making efforts from legal, procedural, and emotional perspectives.
After relentless efforts, we ultimately secured Mr. Wang's bail within 30 days without refunding any amount.
This result is hard-won. In practice, in many similar cases, the parties involved are often required to make a refund before being granted bail. The key to obtaining bail without making a refund lies in the strong trust and close cooperation between the couple and their lawyer.
In contrast, we once handled a case involving a programmer. Although the party was willing to plead guilty and make restitution in order to seek bail as soon as possible, their mother was firmly opposed. Ultimately, due to a failure to take timely action, a good opportunity was missed, and the party is still in detention to this day.
Therefore, we recommend that everyone communicate more with their family about work content, especially when it involves emerging industries or areas with ambiguous legal boundaries. This way, when unexpected situations arise, family members will not be completely out of control and are more likely to understand and cooperate with the judgments of professionals.
Finally, we sincerely suggest: we hope everyone will never need a lawyer, but if possible, it's a good idea to have a trustworthy lawyer friend in case of emergencies. At the same time, it's important to learn basic legal knowledge so that when facing unexpected risks, one can remain calm, make the right judgments, and better protect oneself and family.
